Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of ShareCaster: the ShareCaster mobile application, the website at this domain, and the related services (together, the “Service”), operated by ShareCaster (“we”, “us”, “our”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service

ShareCaster is a voice-directed podcast studio. You describe an idea out loud; ShareCaster drafts a script, lets you shape it with spoken notes, and renders it into a listenable audio episode. Generating episodes requires an account, and the audio you record is uploaded to our servers and processed there. You may keep episodes private or publish them so that anyone can listen.

Eligibility and accounts

You must be at least 13 years old, or the minimum age required in your country to consent to the processing of your personal data, to use the Service. You are responsible for the activity that happens under your account and for keeping your sign-in credentials secure. Please notify us promptly of any unauthorised use of your account.

Acceptable use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal or internal business purposes. You agree not to:

• use the Service in violation of any applicable law or regulation;
• upload recordings or content that you do not have the rights to use, or that infringe the rights of others;
• upload or generate content that is unlawful, harmful, harassing, defamatory, or otherwise objectionable;
• attempt to reverse engineer, decompile, or disrupt the Service, or access it through automated means except as we expressly permit;
• resell, sublicense, or commercially exploit the Service itself.

Your content and the licence you grant us

You retain ownership of the voice recordings you upload and the episodes, scripts, titles, and artwork you create with the Service (“Your Content”). To operate the Service, you grant us a worldwide, non-exclusive licence to host, store, process, and reproduce Your Content, including sending recordings and text to the third-party providers that perform generation and audio hosting. If you choose to publish an episode, that licence extends to distributing it publicly as described below. You are responsible for Your Content and for having the rights necessary to upload and publish it.

Publishing and public episodes

Publishing an episode makes it publicly accessible through a shareable web page and a podcast RSS feed, which third parties and podcast directories may index and cache. Do not publish content you intend to keep private. You may unpublish an episode, but copies that were already downloaded, cached, or syndicated may persist outside our control.

Subscriptions, credits, and payments

Some features require a paid subscription or credits. Purchases made in the mobile app are processed and billed by the applicable app store under its own terms, and paid subscriptions renew automatically until cancelled. You can manage or cancel a subscription through your app store account. Except where required by law or the app store’s policies, payments are non-refundable.

Intellectual property

The Service and its contents, features, and functionality, excluding Your Content, are owned by ShareCaster and its licensors and are protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to our trademarks or branding.

Third-party services

The Service relies on third-party providers for functions such as authentication, payment processing, analytics, error reporting, AI-assisted generation, and audio hosting. Your use of the Service may be subject to those providers’ terms, and we are not responsible for their services.

Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, or that generated content will be accurate or suitable for any purpose.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SHARECASTER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Changes to the Service and these Terms

We may modify or discontinue parts of the Service, and we may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect the Service or other users.

Governing law

These Terms are governed by the laws of the jurisdiction in which ShareCaster operates, without regard to its conflict-of-law provisions.
